These Terms of Service ("Terms") govern your access to and use of the website, mobile experience, and AI-powered tools operated by Lakewood Med Spa, PLLC ("Lakewood Med Spa," "we," "our," or "us"), located at 8210 Walnut Hill Lane, Suite 516, Dallas, Texas 75231. By accessing or using this website, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
1. Proprietary AI Skin Analysis Algorithm
The AI-powered skin analysis system available on this website — including its underlying clinical logic, treatment routing rules, severity matrix, device sequencing protocols, combination treatment mandates, Fitzpatrick safety gates, phased treatment journey framework, and all associated output schemas — constitutes proprietary intellectual property of Lakewood Med Spa, PLLC and its Medical Director, Dr. Rajan Kohli, MD.
This algorithm was developed through original clinical expertise, iterative physician-directed refinement, and substantial investment of time and resources. It is protected under United States copyright law as an original literary and technical work, and may also constitute a trade secret under the Texas Uniform Trade Secrets Act (Tex. Civ. Prac. & Rem. Code § 134A) and the federal Defend Trade Secrets Act (18 U.S.C. § 1836).
Prohibited Uses — AI Algorithm
You may not, directly or indirectly: (a) reverse engineer, decompile, disassemble, or attempt to derive the source code, logic, rules, or clinical protocols of the AI algorithm; (b) use automated tools, bots, scrapers, or repeated queries to reconstruct, approximate, or replicate the algorithm's behavior; (c) copy, reproduce, distribute, sell, license, sublicense, or create derivative works based on the algorithm or its outputs; (d) use the algorithm's outputs to train, fine-tune, or improve any competing AI system, machine learning model, or clinical decision tool; or (e) represent the algorithm or any derivative thereof as your own original work.
Violation of this section may result in civil liability for copyright infringement, misappropriation of trade secrets, and/or unfair competition, and may subject the violating party to injunctive relief, actual damages, disgorgement of profits, and attorneys' fees.
2. Intellectual Property & Copyright
All content on this website — including but not limited to text, graphics, photographs, logos, treatment descriptions, clinical protocols, blog articles, patient education materials, design elements, and software — is the exclusive property of Lakewood Med Spa, PLLC or its licensors, and is protected by United States and international copyright, trademark, and other intellectual property laws.
The "Lakewood Med Spa" name, logo, and the phrase "Inside-Out Aesthetics" are proprietary marks of Lakewood Med Spa, PLLC. Unauthorized use of these marks is strictly prohibited.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and view this website for personal, non-commercial purposes only. No content may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any form without our prior written consent.
3. Medical Disclaimer & No Physician-Patient Relationship
The content on this website, including the AI skin analysis results, blog articles, treatment descriptions, and all other health-related information, is provided for general informational and educational purposes only. It does not constitute medical advice, diagnosis, or treatment.
The AI skin analysis tool generates personalized treatment suggestions based on visual analysis of submitted photographs. These suggestions are not a substitute for a professional medical evaluation by a licensed physician. Results may vary. Individual candidacy for any treatment must be determined by a qualified medical provider following an in-person consultation.
Use of this website does not create a physician-patient relationship between you and Lakewood Med Spa or Dr. Rajan Kohli, MD. Do not delay seeking professional medical advice based on information obtained from this website.
4. Acceptable Use Policy
You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others. You may not:
Use automated scripts, bots, crawlers, or scrapers to access, collect, or index any content from this website without our express written permission.
Submit photographs of individuals other than yourself, or photographs of minors, to the AI skin analysis tool without proper authorization.
Attempt to gain unauthorized access to any portion of the website, server, database, or associated systems.
Use the website or its outputs for competitive intelligence, market research, or to develop competing products or services.
Transmit any content that is unlawful, harmful, defamatory, or that infringes any third-party intellectual property rights.
Interfere with or disrupt the integrity or performance of the website or its associated infrastructure.
5. User-Submitted Photographs
By submitting a photograph through the AI skin analysis tool, you represent and warrant that: (a) you are the individual depicted in the photograph or have obtained explicit consent from the individual depicted; (b) you are at least 18 years of age; and (c) you grant Lakewood Med Spa a limited, non-exclusive license to process the photograph solely for the purpose of generating your skin analysis results.
Submitted photographs are processed in real time and are not stored on our servers beyond the duration of your session. We do not use submitted photographs to train AI models or for any purpose other than generating your individual analysis results.
6. Limitation of Liability
To the fullest extent permitted by applicable law, Lakewood Med Spa, PLLC, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of this website or the AI skin analysis tool, even if advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the website shall not exceed one hundred dollars ($100.00).
7. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the website shall be resolved exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of such courts.
For disputes involving the proprietary AI algorithm or intellectual property, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction without the requirement of posting a bond or other security.
8. Privacy
Your use of this website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.
9. Changes to These Terms
